Terms of Service

These terms and conditions govern the way in which Bourne IT Learning (‘we’) supply E-Learning course(s) to you. Please read these terms carefully before you purchase a course through our site. These terms tell you how we will provide E-Learning course(s) to you, how you and we may change or end the contract, what to do if there is a problem and other important information. All rights not expressly granted in these terms are hereby reserved.

You agree to review this agreement periodically to ensure that you are aware of any amendments to this agreement, which may be made at any time.


Agreement of License 

In receipt of your payment, you are permitted a licence to use the purchased E-Learning course(s). This licence is limited, non-transferable, revocable, non-exclusive, non-sublicensable, and is subject to the rights and obligations granted under these Terms.

This licence is personal to you and cannot be shared or exchanged with others.

Your licence is granted for a term of twelve (12) months or 365 days from the date of purchase.

 

General Use

We develop, distribute and maintain the E-Learning course(s) and will also provide you with log in details. We will also manage your access to the E-Learning course(s) and provide support to you, where necessary.

You shall not copy, modify, transmit, distribute or in any way exploit the E-Learning course(s) or any other copyrighted materials provided other than for your individual training. Any other purpose is expressly prohibited under these terms. You shall also not permit anyone else to copy, use, modify, transmit, distribute or in any way exploit the E-Learning course(s) or any other copyrighted materials.

We do not warrant that the materials will be error free, including any technical inaccuracies.


Access to Courses 

The starting date of your access to the E-Learning course(s) is deemed to be the date that you first have access.

As such, it is your responsibility to ensure that you complete the content within the allocated time period. If you do not think this will be possible, then extensions of time are available for purchase at an additional cost. We will take all reasonable steps to provide you with uninterrupted access to the E-Learning course(s). However, your access may be restricted at random times for reasons beyond our control. These reasons can include, but are not limited to, unforeseeable circumstances, power outages and actions from computer hackers and others acting outside the law. Your access may also be interrupted due to software issues, server downtime, increased Internet traffic, regular maintenance and other related reasons.

Improvements or changes to the E-Learning course(s) or any other materials may occur at any time without prior notification in order to ensure they remain up to date and accurate.


Course Content

When purchasing a course, you agree that you have reviewed the content prior to purchasing and are satisfied with the content the course will be covering. We will not accept any responsibility where courses have been purchased mistakenly based on content.   


Payment Processing

We use a third-party payment processor – Stripe UK. Payment for the E-Learning course(s) must be made at the point of purchase. You agree to provide payment for the E-Learning course(s) in the stipulated currency and you will be liable to pay any relevant conversion charges, as well as applicable sales tax in your region.

We must receive your payment in full before providing you with access to the E-Learning course(s).

Your payment includes the licensing of the E-Learning course(s) for a limited period that is appropriate for the E-Learning course(s) content. We are unable to provide a refund if you fail to complete the content within the allocated time. We reserve our right to review and change the pricing of any of our E-Learning course(s). This will not affect E-Learning course(s) that have already been purchased.


Web Browsers

All E-Learning courses are accessed and viewed via web browsers such as Microsoft Edge, Google Chrome, Mozilla Firefox and Apple Safari. It is your responsibility to ensure you have the latest version of the browser installed on your device in order to access and view the content of your course. Courses can be accessed via a PC running Windows 10 or Windows 8.1 and Apple macOS Mojave or newer operating systems.

We will not be held responsible for content that cannot be viewed, displayed or heard correctly or as intended due to out of date software or personal settings on your web browser or computer preventing the content being shown correctly.


Cancellation and Restriction Policy 

It is your responsibility to review the course outline before purchasing to ensure the content is what you want to learn. Each course will list the modules and content covered before you purchase the course. Refunds will not be issued due to non-review of the content prior to purchasing.

Furthermore, it is your responsibility to ensure that you meet the system requirements, including compatible hardware, software, telecommunications equipment and Internet service, prior to purchasing any content. We are unable to provide refunds where your access to the E-Learning course(s) is inhibited due to insufficient system requirements.


Third-Party Vouchers 

Where you have purchased third-party vouchers to access an E-Learning course(s), these vouchers will be subject to the terms and conditions of the relevant third-party voucher vendor. These vouchers are non-refundable once they have been used to purchase a course(s). These vouchers may also have an expiry date as stated by the third-party vendor, for which you are responsible to redeem these vouchers before the expiry date. No refunds will be provided if you do not redeem the voucher before the expiry date.


Intellectual Property 

All rights, title and interest in intellectual property rights relating to the E-Learning course(s) including copyright, patents, trademarks, trade secrets, improvements, developments, proprietary information, know-how, processes, methods, business plans or models (including computer software and preparatory and design materials thereof) and all other intellectual property (whether registered or not) developed or created shall exclusively be owned by Bourne IT Learning.

While you may utilise the intellectual property, you understand that there shall be no transfer of ownership of the same. Nothing that you see or read in the E-Learning course(s) may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use. All other trademarks, service marks and trade names in this material are the marks of the respective owners and any unauthorised use is prohibited.
